With premium, are we actually getting 320 kbps ogg?

Whenever I compare Spotify highest quality to 320 kbps CD rips, my CD rips sound better. Is spotify lying to us about the premium quality?

Are you listening to newer music or older stuff?  My guess is they only have high quality rips for newer stuff and only for some of the older stuff and they update it slowly... but also all releases these days are done digitally and Spotify doesn't have to do any ripping themselves, so they may be restricted to what the artist/label provides?
