Spotify on Windows phone not a background app?

When I listen to Spotify and get a call and that takes longer than a few minutes Spotify is closed. I don't see Spotify in the list of background apps, so I assume that this is the reason.
Is there a reason for not registering as a background app?

It was a bug I reported YEARS AGO. Oh really, even on Windows Phone 7 app...

Is it fixed on 7 pr 8? No!
