Sometimes music gets greyed out because either the artist/label wanted so, or there are some licensing things going on (rights changing hands, changes in licensing being made, etc), and until those things get sorted out, the songs are made unavailable.

Spotify is not fooling anyone.  It made the songs available without a license.  May have been inadvertent but they got busted/sued. Pay up, be more careful and stop short changing customers .  Apple Music has these songs.
