Was loving Spotify Until Now....

So, my iPod Touch loves to quit streaming whenever it wants. Pandora, Sirius XM work just fine. Then I update my iTunes software and the darn thing tells me I can't download it because it requires iOS 5.0????!!!! And I have a Premium subscription.......
